Terms and Conditions Agreement

The Diamond Valet, operates an efficient, safe and trusted diamond buying service for your unwanted diamond ring. We are a leading provider of quick payments for your items. The terms and conditions contained herein and those described on the Company’s website including the Privacy Policy which is incorporated by reference as if fully set forth herein (to be read in combination and referred to herein in their entirety as “The Agreement”) shall be binding on each and every customer of The Diamond Valet and shall inure to the benefit of The Diamond Valet and it’s successors and assigns.

Requirements For Use: By shipping your goods to us, you agree to all of the terms and conditions set forth herein and that you are a legal U.S. citizen, at least 18 years of age and you are the lawful owner of the each item you wish to sell to us.  Additionally, you agree that the items you send to us are not stolen or borrowed and you are not acting as a third party or agent for the sale of your items.  In accordance with PA State Code 37, Ch. 501, Section 501.6, you must provide us with a signed statement of ownership as well as a government issued identification.  Failure to return the requested information will result in a delay in payment of your item as well as the potential return of items sent to our company to your address on record.  We may also require additional information by you in order to securely process your transaction.  We fully comply with all Patriot Act and Anti-Money Laundering policies and regulations. Payments from our office to you will only be submitted via company check, cashier’s check, direct bank wire, Western Union™ or via PayPal™.  Please note: information submitted on our site by you may be disclosed to judicial or other government agencies, subject to warrants, subpoenas, or other governmental orders.  As required, The Diamond Valet fully complies with all local, State and Federal laws that regulate the commerce of diamond sales via the Internet.

Guaranty Against Loss And Insurance:  Except as otherwise stated herein, The Diamond Valet will provide insurance coverage against the loss of contents that are shipped using the pre-labeled Federal Express or UPS shipment box or USPS Priority Mail shipment box.  Insurance valuation is based on the diamond trade wholesale market liquidation valuation for a like quality diamond as described by you.  However, in no event shall The Diamond Valet be liable for any subrogation claim brought by the customer against the company.  And, by submitting your item to The Diamond Valet, you waive any right to subrogation claim against the company for any reason.  If you ship your items to us in our USPS Priority Mail shipment box, the limitation of insured replacement value shall not exceed $USD 1,500.00 for any shipment.  If you feel your items are worth more than $USD 1,500.00 in replacement value and you ship with our USPS Priority insurance shipment box, you are responsible for adding any additional insurance coverage to your shipment. If you ship your items to The Diamond Valet in our Federal Express or UPS shipment box, the limitation of insured replacement value shall not exceed $10,000 for any shipment, unless and only with prior written authorization from The Diamond Valet.  We insure your Federal Express, UPS or USPS Priority Mail shipment box for the expected wholesale replacement cost, which is determined at our discretion, based on prevailing wholesale market prices for your item.

Limitation of Liability:  The Diamond Valet limitation of liability extends to all contents received in our offices by you shipped to us in our Federal Express, UPS or via USPS Priority Mail shipment box. The limitation of liability extends to you, your successors, carrier insurance companies and third party shipping carriers.  If the contents of your package are lost or stolen in transit, our liability will extend to the following, based on our agreed interpretation of the potential value of your item(s):

  • Payment of fair compensation in USD of the diamond trade wholesale market liquidation value (replacement value) of your items, as defined by the agreed condition of your diamond and the prevailing current wholesale market liquidation for your diamond on the Rapaport Diamond Exchange.   Claims must be made to our offices via phone call, email or fax within 10 days after your Federal Express, UPS or USPS Priority Mail shipment box is sent back to our offices.  We reserve the right to investigate your claim for up to 30 days from your initial claim date.

In absolutely no event will The Diamond Valet be held liable for any loss of profit, loss of time, punitive damage or otherwise except as described in our Terms and Conditions. This Terms and Conditions will be binding when your contents are shipped to us in our Federal Express, UPS shipment box or via USPS Priority Mail shipment box.

Verbal Offer:  If you contact The Diamond Valet for a verbal or email offer on the cash value of your item(s), we will make an offer, pursuant to the receipt of such contents in our office for visual inspection. The final offer may be higher OR lower, depending on our visual inspection. If you accept our offer after visual inspection of your item in our offices, we can send you your check payment within 48 hours. If you do not accept our offer, your items will be returned to you via USPS First Class Registered Mail, USPS Priority Mail, UPS or Federal Express expedited insured delivery.  Insurance values on return items will again be calculated against the current wholesale market liquidation value (replacement value) of your item as reported on the Rapaport Diamond Exchange.

Payment:  When you sell your diamond(s) to us, we retain the option to pay for your items based on market pricing conditions and market volatility. If for any reason you are not satisfied with your check payment on receipt, please call our offices to discuss payment alternatives.  Your call must be received by one of our customer service representatives with 10 business days of the date on your check. All customer checks are mailed via Federal Express or UPS expedited delivery or standard USPS First Class Mail.  We will also require that you mail the check back to us within 10 days as well. Your items will be returned either via USPS First Class Registered Mail, USPS Priority Mail or Federal Express expedited insured delivery. We will not be held liable for items not received and signed for by you once your items are mailed back from our offices to your address on record via the aforementioned delivery services.  The Diamond Valet provides diamond trade wholesale liquidation value insurance on all outbound customer return shipments.  After evaluation and emailed offer, our purchase offer is good for up to 10 days.

Jurisdiction:  By submitting your items to The Diamond Valet, you agree that our services shall be deemed solely based in the State of Pennsylvania and that The Diamond Valet shall be deemed a passive web site and our services do not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than the State of Pennsylvania.  You and we agree to submit all disputes between us to the exclusive jurisdiction of the state and federal courts located in York County, Pennsylvania.
